Welcome to Caut.eu! These Terms and Conditions (the "Terms") govern access to and use of the online platform caut.eu (the "Platform" or "Caut.eu") and all services offered through it.

Please read these Terms carefully before using the Platform. By creating an account, posting a Listing, sending an Offer or otherwise using the Platform, you confirm that you have read, understood and agree to be bound by these Terms and any documents referenced herein.

1. Definitions

  • Operator – the company that owns and operates Caut.eu: Clever Applications Srl, registered office at Dobrestilor 4 Str. Dobrestilor nr.4 Bloc PC10 ap.5, Oradea, Romania, registered with the Romanian Trade Registry under no. Clever Applications Srl, tax ID RO38512350, e-mail: sorin@clevercode.eu.
  • Platform – the caut.eu website, associated apps and all functionalities made available by the Operator.
  • User – any individual of legal age or legal entity accessing the Platform, with or without a registered account.
  • Account – the personal area created upon registration, accessed via email and password.
  • Listing (or "Request") – the description of the good, service or need posted on the Platform by a User looking to receive proposals.
  • Requester – the User who publishes a Listing in order to receive Offers from other Users.
  • Offer – the proposal (price, conditions, description) sent in response to a Listing.
  • Offerer – the User who sends an Offer in connection with a Listing.
  • Content – any text, image, description, message, offer or other material posted or transmitted by Users through the Platform.
  • Paid Services – optional charged features such as Listing promotion, featured packages or other premium facilities.
  • Wallet – the virtual balance attached to the Account, topped up via electronic payments and used to pay for Paid Services.

2. About Caut.eu

Caut.eu is an online platform that facilitates connections between people looking for a product or service and those who can provide it. The Platform model is as follows: a Requester publishes a Listing describing what they are looking for, and interested Offerers reply with personalised proposals. The Platform acts solely as an intermediary and communication tool.

Caut.eu does not sell goods or provide services in its own name, holds no inventory of items mentioned in Listings or Offers and does not warrant their quality, legality or delivery. Transactions are concluded directly between Users, outside the Platform.

3. Acceptance of Terms

Any use of the Platform constitutes express acceptance of these Terms. If you do not agree with any provision, you must immediately stop using the Platform and refrain from creating an account.

Certain features may be governed by additional terms (e.g., specific conditions for Paid Services). In case of conflict, the special provisions prevail over the general ones.

4. Eligibility and account registration

To create an account and use the Platform you must:

  • Be at least 18 years old, or be the legal representative of a legal entity;
  • Have full legal capacity;
  • Provide truthful, complete and up-to-date information at registration;
  • Maintain the confidentiality of your login credentials;
  • Use a single account per person / entity, unless otherwise approved in writing by the Operator.

The Operator may refuse registration or suspend an Account where it suspects false information, fraud or breach of these Terms.

5. Account types

  • Individual – for personal use, not directed at continuous economic activity;
  • Legal entity / sole trader – for Users acting commercially. They must provide complete billing details (name, tax ID, address, IBAN where applicable) and comply with applicable tax law.

The same Account may be used both to publish Listings and to send Offers. No User is restricted to a single role.

6. General usage rules

While using the Platform you commit to:

  • Comply with the laws of Romania and the European Union;
  • Refrain from posting illegal, defamatory, obscene, discriminatory, violent Content or Content that infringes third-party rights;
  • Not impersonate other persons or entities and not use false email addresses;
  • Not use the Platform for spam, phishing, fraud or unauthorised data collection;
  • Not attempt to gain unauthorised access to other accounts or to the Operator's systems;
  • Not use bots, scripts or automated means to scrape data or manipulate Platform features.

7. Rules for publishing Listings

  • Post a single Listing per actual need, no duplicates;
  • Choose the correct category and subcategory;
  • Provide a clear, accurate and complete description of what you are looking for;
  • Do not place contact details in title or body unless the Platform explicitly allows it;
  • Do not post Listings for prohibited content (section 9);
  • Do not use irrelevant keywords, excessive capitalisation, symbols or formatting tricks aimed at artificial visibility;
  • Reply in good faith to received Offers and do not mislead Offerers as to your real intent.

The Operator reserves the right to edit, hide or remove any Listing that breaches these Terms, without being required to provide detailed explanations.

8. Rules for sending Offers

When sending an Offer, you warrant that:

  • You have the legal right to sell the good, provide the service or otherwise supply what is requested in the Listing;
  • The Offer is made with genuine intent to contract;
  • The price and conditions are accurate and complete (including delivery, VAT, warranty if applicable);
  • The good / service is not on the prohibited content list;
  • You will not send spam Offers, multiple identical Offers to the same Requester, or Offers unrelated to the Listing.

Acceptance of an Offer by a Requester does not create a sales contract through the Platform. The transaction is concluded outside the Platform, between the two parties, in accordance with the law applicable to their relationship.

9. Prohibited content

It is strictly forbidden to post Listings or Offers for the following categories of goods and services (non-exhaustive list):

  • Firearms, ammunition, explosive materials;
  • Drugs, controlled substances and precursors;
  • Tobacco, alcohol and goods whose distance sale is restricted;
  • Prescription medication, unauthorised supplements, restricted medical devices;
  • Protected animal species, parts thereof, live animals sold without papers;
  • Counterfeit goods, replicas, fake trademarks;
  • Pornographic content, materials exploiting minors, content promoting violence;
  • Sexual services, escort services, sexually explicit content;
  • Official documents, IDs, diplomas, permits;
  • Third-party personal data, illegally collected databases;
  • Unregulated financial services, cryptocurrencies, pyramid schemes, unregulated loan offers;
  • Stolen goods or goods obtained through illegal activities;
  • Any other product or service prohibited under Romanian, European or applicable international law.

10. Internal messaging

The Platform provides a messaging system for direct communication between Requester and Offerer. By using messaging, you commit to:

  • Maintain a civil and professional tone;
  • Not transmit illegal, offensive, discriminatory or spam content;
  • Not collect another User's personal data for purposes other than completing the transaction;
  • Not transmit external links to competing or rule-breaking sites.

The Operator reserves the right to automatically monitor messages for fraud and prohibited-content detection, in accordance with the Privacy Policy.

11. Paid Services

  • Listing promotion (Featured) – priority exposure of a Listing in search results and main pages, for a chosen period;
  • Featured packages – pre-defined combinations of promotion with different durations and benefits;
  • Other premium services described on dedicated pages at launch.

Pricing, duration and benefits are displayed before checkout. By confirming the order, the User declares awareness and agreement with the applicable conditions.

12. Wallet, payments and invoicing

  • The Platform operates on a virtual Wallet system;
  • Users top up the Wallet via card payments processed securely by our payment provider (Stripe). The Operator does not store full card data;
  • The Wallet balance is used to pay for Paid Services;
  • The Wallet balance is non-transferable between accounts and cannot be converted into cash, except for refunds required by law;
  • For each top-up and each Paid Service, the Operator issues an electronic invoice available in the "My Invoices" section of the Account;
  • Prices displayed include VAT (where applicable), per applicable law.

13. Right of withdrawal and refund policy

Pursuant to GEO 34/2014 on consumer rights in distance contracts, the consumer-User has the right to withdraw from a distance contract within 14 days, without justification.

With statutory exceptions:

  • For already-consumed Paid Services (e.g., promotion that has started and been displayed) the right of withdrawal is lost, since service performance began with the User's express consent and acknowledgment of losing the withdrawal right upon performance start;
  • For unspent amounts in the Wallet, the User may request a refund to the original payment method, within the 14-day legal term from the request date;
  • Refund requests are sent to support@caut.eu with account details and reason.

14. Account suspension or closure

The Operator may, at its sole discretion and without prior notice, temporarily suspend or permanently close an account if:

  • These Terms are breached;
  • Behaviour is abusive, fraudulent or harmful to other Users;
  • False information is provided or impersonation actions occur;
  • Repeated, substantiated complaints are received from other Users;
  • A competent authority requires it.

Upon account closure, unspent Wallet balance may be refunded under section 13, less amounts already consumed for Paid Services.

15. Limitation of liability

  • The Operator is not a party to transactions between Users and assumes no liability for quality, conformity, delivery, payment or any other transaction aspect;
  • The Operator does not guarantee that a Listing will receive Offers, or that an Offer will be accepted;
  • The Operator uses reasonable diligence to ensure continuous Platform operation but does not guarantee absence of interruptions, technical errors or data loss;
  • To the extent permitted by law, the Operator's liability to a User is limited to the total amount paid by that User for Paid Services in the 12 months preceding the event giving rise to the claim.

16. Intellectual property

The Platform, the "Caut.eu" name, the logo, design, source code, texts, illustrations and all other materials created by the Operator are protected by copyright and trademark law. No part of the Platform may be reproduced, modified, distributed or used commercially without prior written consent from the Operator.

User-uploaded Content (texts, images, etc.) remains the User's property. By posting, the User grants the Operator a non-exclusive, royalty-free licence valid for the lifetime of the Account and a reasonable period thereafter, to display, store, copy and distribute the Content for the purpose of operating the Platform.

17. Personal data protection

Processing of personal data is performed in accordance with Regulation (EU) 2016/679 (GDPR) and the Privacy Policy available at /page/privacy-policy. The Privacy Policy is an integral part of these Terms.

18. Cookies

The Platform uses cookies and similar technologies in accordance with the Cookie Policy available at /page/cookie-policy.

19. Changes to the Terms

The Operator may amend these Terms at any time. Changes take effect upon publication on the Platform, save where the law mandates a notice period.

Significant changes will be communicated by email and/or via a visible notice on the Platform. Continued use after the entry into force of the changes constitutes acceptance of the new Terms. If you disagree with the changes, you may stop using the Platform and request Account closure.

20. Dispute resolution

Any dispute arising from the interpretation or performance of these Terms shall first be settled amicably. Failing that, the parties may turn to:

  • ANPC – the Romanian National Authority for Consumer Protection (anpc.ro);
  • European Commission ODR Platform for online dispute resolution (ec.europa.eu/consumers/odr);
  • The competent courts of Romania.

21. Force majeure

Neither party shall be liable for late or improper performance of obligations under these Terms if caused by force majeure or fortuitous event, as defined under the Romanian Civil Code.

22. Final provisions

  • These Terms are governed by Romanian law;
  • If any provision is declared null or unenforceable, the remaining provisions remain in force;
  • The written form requirement for any notice is deemed satisfied by sending an email to the addresses indicated;
  • Any tolerance or delay by the Operator in exercising a right does not constitute a waiver of that right.
